Statutory minimums under provincial Employment Standards Acts (ESA) guarantee only basic termination pay (typically 1 week per year up to 8 weeks, plus up to 26 weeks severance in Ontario). However, unless a valid employment contract enforceable under law limits you to statutory minimums, Canadian courts award significantly higher 'Common Law Reasonable Notice' (often 3 to 4 weeks per year up to 24 months).
Established by Canadian jurisprudence, the four key Bardal factors are: (1) Employee age, (2) Length of continuous service, (3) Character and seniority of employment, and (4) Availability of similar employment in the current job market.
Severance pay (retiring allowance) is subject to lump-sum withholding tax (10% up to $5k, 20% from $5k-$15k, 30% over $15k). You can defer taxes by transferring eligible amounts into an RRSP if you have contribution room (or pre-1996 service room).
